1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of U Never Sleep ("we," "our," or "us"), including our website, dashboard, automation tools, support channels, and related services (the "Service").

By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

  • You must be at least 18 years old to use the Service.
  • You are responsible for keeping your account login and connected accounts secure.
  • You must provide accurate information and keep it current.
  • You are responsible for all activity under your account.

3. Service Description

U Never Sleep helps freelancers and agencies discover relevant Upwork opportunities, configure job-matching prompts, receive notifications, generate proposal drafts, and optionally automate proposal submission where enabled for your account.

Features may vary by plan, account configuration, third-party availability, and operational limits. We may improve, change, pause, or discontinue parts of the Service when necessary to operate or secure the product.

4. Upwork and Third-Party Services

The Service interacts with third-party platforms, including Upwork and payment, analytics, hosting, email, and AI providers. We do not control those third-party services and are not responsible for their availability, decisions, policy changes, or account actions.

You are responsible for reviewing and complying with the terms, policies, and rules of any third-party service you connect or use with U Never Sleep.

5. Acceptable Use

You agree not to use the Service to:

  • Violate laws, platform policies, or third-party rights.
  • Submit deceptive, abusive, spammy, or misleading proposals or messages.
  • Attempt to bypass access controls, usage limits, billing gates, or security systems.
  • Reverse engineer, scrape, overload, or interfere with the Service.
  • Upload or transmit malware, secrets you are not allowed to share, or illegal content.

6. AI-Generated Content

The Service may generate job analysis, filters, proposal drafts, and related text with AI systems. AI output can be inaccurate, incomplete, or inappropriate for a specific opportunity.

You are responsible for reviewing prompts, settings, generated content, and any proposal or communication sent from your account.

7. Payments, Subscriptions, and Auto-Responses

  • Paid plans, subscriptions, credits, and auto-response packages are billed through our payment providers.
  • Prices, plan limits, included features, and renewal terms are shown at checkout or in the dashboard.
  • Auto-responses or credits may be required before automated proposal submission is available.
  • All purchases are non-refundable once delivered to your account, except where required by law.

8. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you agree that we may process data as described there and as necessary to provide, secure, and improve the Service.

9. Availability and Disclaimers

We work to keep the Service reliable, but we do not guarantee uninterrupted operation, specific job availability, proposal volume, client replies, earnings, or marketplace outcomes.

The Service is provided "as is" and "as available" to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, U Never Sleep will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, or third-party platform actions arising from or related to your use of the Service.

11. Suspension and Termination

We may suspend or terminate access to the Service if you violate these Terms, create risk for other users or the Service, fail to pay fees, or use the Service in a way that may violate law or third-party platform rules.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.
